Case summary
On June 4, 2021, the Region filed an Expedited Settlement Agreement which settled EPA's penalty claim for violations of CWA Section 311(j) at the Vicinity Energy Schuylkill Generating Facility located in Philadelphia, Pennsylvania. EPA conducted an inspection of the facility on March 5, 2020 and discovered that the facility failed to prepare an adequate Spill Prevention, Control, and Countermeasure (SPCC) Plan and failed to maintain adequate dike drainage records. The respondent has agreed to pay a cash penalty of $2,494 to settle the matter. PADEP representatives were present during the inspection and raised no objections to this action.
