On May 27, 2021, Region 3 filed a signed Consent Agreement and Final Order (?CAFO?) resolving alleged violations of the CWA pretreatment standards and regulations by Overhead Door Corporation (?Overhead Door?) based in Lewiston, PA. Overhead Door is subject to the Metal Finishing Category Pretreatment Standards for Existing Sources at 40 C.F.R. 433.15 and has experienced chronic zinc effluent exceedances dating back to December 2016. The facility also had lapses in sampling, reporting, and notifying EPA of exceedances. Pennsylvania does not have an approved NPDES pretreatment program, and the POTW that Overhead Door discharges to does not have an approved POTW pretreatment program, so EPA is both the ?Approval Authority? and ?Control Authority.? The Pennsylvania Department of Environmental Protection was informed of this enforcement matter. The Respondent will pay a $55,000 civil penalty. On March 17, 2021, Respondent also agreed to a compliance order on consent addressing the violations at the facility.
