Case summary
On February 4, 2021, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle RCRA violations and violations of Virginia's underground storage tank (UST) program by Republic Services of Virginia LLC d/b/a AAA Recycling and Trash Removal Services. Republic Services is the UST owner and operator of a 15,000 gallon UST located at AAA Recycling and Trash Removal Services in Fairfax, Virginia. Region 3's enforcement team, in coordination with VADEQ, was able to resolve the UST violations of failing to have an overfill prevention device on the tank, and failure to maintain records of checks of the impressed current rectifier system which maintains corrosion protection for the UST system. The violations were discovered through information collected from an Off-Site Compliance Monitoring Letter that was sent to the facility on August 10, 2020, and subsequent information gathering. The respondent has agreed to pay a $1,540 penalty and has returned to compliance with the violations.
