Case summary
On February 24, 2021, EPA Region III entered into a Consent Agreement and Final Order with Monumental Concrete, LLC regarding violations of the Clean Air Act CAA ) and Washington, D.C''s. ( The District ) State Implementation Plan in connection with violations at its concrete batch plant. This enforcement action furthers the CAA's purpose of protecting the public health and welfare from air pollutants. The Consent Agreement alleges that Monumental Concrete violated its operating permit by operating the plant outside permitted limits, failing to appropriately track plant hours of operation, operating the baghouse at the Facility outside of the differential pressure range, failing to keep complete records, and failing to document visible emissions exceedances or fugitive emissions. The Consent Agreement included a penalty of One Hundred Forty-Nine Thousand Eight Hundred and Ninety-Nine Dollars ($149,899). The District's Department of Energy and Environment was consulted in this matter and had no objections to this action.
