Case summary
On June 10, 2021, EPA Region III filed a signed Administrative Order on Consent (AOC) resolving violations of the CWA by the Pennsylvania Turnpike Commission (PTC) at several PTC construction sites. In the AOC EPA alleged that PTC violated the applicable NPDES construction stormwater permit by failing to implement and/or maintained appropriate stormwater controls. The principal pollutants of concern are sediment and TSS. In the AOC, as part of the settlement, the PTC agreed to implement a compliance management plan at its construction sites to ensure compliance with the CWA permits. The plan requires electronic self-inspection forms, audits during the construction season, employee and contractor training on stormwater compliance and the posting of stormwater compliance information on a public web page. EPA communicated with PADEP regarding the proposed AOC.
