Case summary
On December 11, 2020, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle RCRA violations and violations of Pennsylvania's underground storage tank (UST) program by Om Shiva Management, Inc., UST owner and operator, and Shriji Group Enterprises, LLC, Facility property owner, of four USTs located at Valero McKeesport in McKeesport, PA. Region 3's enforcement team, in coordination with PADEP, was able to resolve the UST violations of failing to conduct annual line leak detector functionality testing on four USTs. The violations were discovered through information collected during an inspection at the facility on September 12, 2019 by the ESS section and subsequent information gathering by the RCRA section. The respondents have agreed to pay a $3,760 penalty and have returned to compliance with the violations.
