Case summary

On February 3, 2021 the Regional Judicial Officer signed a Final Order ratifying a Consent Agreement between EPA and Becton Dickinson and Company, located in Sparks, Maryland. The Consent Agreement resolves alleged violations of RCRA C identified during a June 2019 inspection. The hazardous waste management regulations promulgated pursuant to RCRA Subtitle C provide for the management and transport of hazardous waste from the time and place of generation to its ultimate disposition at a RCRA treatment, storage or disposal facility. EPA routinely inspects hazardous waste generators for compliance with RCRA regulations in accordance with joint enforcement goals agreed upon by EPA and states authorized to implement RCRA C. On June 10-11, 2019, EPA Region III inspectors, accompanied by two representatives of the Maryland Department of Environment, conducted a Compliance Evaluation Inspection of the BD facility in Sparks, Maryland. BD is a manufacturer of medical testing devices. EPA inspectors identified several violations associated with BD?s use of small tanks and 55-gallon containers to store hazardous waste. These violations involve failure to mark and label containers, failure to inspect tanks, and failure to monitor the tanks as required by RCRA Subparts BB and CC. Becton Dickinson and Company has thirty days in which to pay the assessed penalty.
