Case summary

On October 14, 2020, EPA Region III settled Clean Air Act (CAA) matter with Dairy Maid Dairy, LLC located in Frederick, Maryland. After a Risk Management Program inspection by the Oil and Prevention Enforcement Section on January 15, 2020, EPA found that the Respondent had violated regulations implementing Section 112(r) of the CAA which requires chemical accident prevention planning at facilities that use certain hazardous substances. Dairy Maid Dairy, LLC which uses anhydrous ammonia in its refrigeration process, specifically failed to provide proper relief vent height, machinery room ventilation, and ammonia pipe labeling. Additionally, Dairy Maid Dairy, LLC failed to provide required information for the Community Emergency Response Plan. Dairy Maid Dairy, LLC has agreed to pay a cash penalty of $2,400 as part of an Expedited Penalty Action and Consent Agreement.
