EPA v. BLESSING GREENHOUSES AND COMPOST FACILITY, INC.

Case summary

On December 7, 2020, EPA, Region 3 entered into an Administrative Order on Consent ( Consent Order ) with Blessing Greenhouses and Compost Facility, Inc. ( Blessing ) located in Milford, DE, alleging violations of the CWA. This enforcement action furthers the CWA's goal of eliminating the discharge of pollutants into navigable waters. On November 5, 2018, Region 3 conducted an inspection at the Site and found violations of the Facility's Stormwater Management Plan and NPDES General Industrial Stormwater Permit. On January 8, 2020, Region 3 sent Blessing a Show Cause Letter describing the alleged violations found during the inspection. The Consent Order requires Blessing to remove all compost material on site and provide a Corrective Action Plan ( CAP ) to address remaining industrial material stored on site. The CAP will include stormwater management devices, collection areas, and/or BMPs to minimize the migration of these industrial materials during stormwater events. EPA notified Delaware Department of Natural Resources and Environmental Control of the action.
