Case summary
On August 5, Region 3 issued a Notice of Refusal of Admissions (NORA) to the U.S. Customs and Border Protection to refuse admission of a misbranded pesticide device imported by Bubble Q Marketing of Arvada, CO through the port of Baltimore, MD. The device is a bottle sterilizer that was not produced in an EPA registered establishment was considered to be misbranded. FIFRA regulates pesticidal products, which includes any substance or mechanical device intended to prevent, destroy, repel, kill, or mitigate a pest. Sale and distribution of a misbranded pesticide device is a violation of FIFRA. On September 1 the customs broker confirmed that the product will be exported out of the country to Hong Kong.
