EPA v. SPIGUS, LLC

Final Order No Penalty

Case summary

On June 3 EPA Region 3 issued a Notice of Refusal of Admissions (NORA) to the U.S. Customs and Border Protection to refuse admission of misbranded insect trap called Spider Cup . The insect trap was refused because it was misbranded in that the label was missing the EPA establishment registration number of the last place of production. Additionally, the cartoon fruit graphics on the label and the overall resemblance to an ice cream pint are considered false and misleading which is also a misbranding. The importer has the option to remove the insect trap from the shipment and destroy them or export them out of the country.
