Case summary
On June 22, Region 3 issued a Notice of Refusal of Admissions (NORA) to the U.S. Customs and Border Protection to refuse admission of a misbranded pesticide device imported by Field Controls, LLC through the port of Norfolk-Newport News, VA. The device is a UV lamp to be installed on air filtering and air purifying devices. FIFRA regulates pesticidal products, which includes any substance or mechanical device intended to prevent, destroy, repel, kill, or mitigate a pest. Pesticide devices must be properly labelled. Sale and distribution of a misbranded pesticide device is a violation of FIFRA. The importer has opted to return the product to the country of origin.
