Case summary
On April 24, 2020, EPA Region 3 issued a Notice of Refusal of Admission (NORA) to the U.S. Customs and Border Protection to refuse admission of a misbranded fly trap, which is considered a pesticide device under FIFRA. The label on the fly trap did not have an EPA establishment number and a full company address, and the label had false and misleading safety claims. Additionally, the fly trap was not produced in an EPA registered establishment, which is a requirement of FIFRA. The product was considered MISBRANDED and sale and distribution of a misbranded pesticide device is a violation under FIFRA. The importer has the option to destroy the product or return it to the country of origin.
