On April 28, Region 3 issued a Notice of Refusal of Admission to the U.S. Customs and Border Protection to refuse admission of an unregistered disinfectant being imported through the port of Norfolk-Newport News, VA. FIFRA regulates pesticidal products, which includes any substance or mechanical device intended to prevent, destroy, repel, kill, or mitigate a pest, which includes disinfectants. Pesticides must be registered with the Agency, properly labelled, and produced in an EPA registered establishment. Sale and distribution of an unregistered pesticide is a violation of FIFRA. The importer has the option to destroy the product or return it to the country of origin. The company has subsequently confirmed that they will destroy the pesticide.
