Case summary
On March 30, Region 3 issued a Notice of Refusal of Admission (NORA) to the U.S. Customs and Protection to refuse admission of a misbranded pesticide. The shipment contained a biocide that was not labelled properly, including missing directions for use, missing storage and disposal instructions, and missing EPA pesticide registration and EPA establishment registration numbers. Thus, the product was considered misbranded . Sale and distribution of a misbranded pesticide device is a violation under FIFRA. The importer has stated that they will export the product back to the manufacturer.
