EPA v. NATIONAL RETAIL PROPERTIES TRUST; CHATHA, INC. (UNIMART 04077)

Final Order No Penalty

Case summary

On February 24, 2020, in coordination with the Pennsylvania Department of Environmental Protection, EPA's RCRA Section of ECAD attached red tags to two of the tanks at the Unimart 04077 gas station located in Punxsutawney, Pennsylvania. This action comes in response to a Notice of Intent to Prohibit Deliveries ( NIPD ) that was issued on January 10, 2020, to National Retail Properties Trust, the owner , and Chatha Inc., the operator , of three underground storage tanks at the facility. The red tags, which notify delivery operators that no new product is to be added to the tanks, are being placed on two tanks that have failed cathodic protection system testing. Cathodic protection is required on steel tanks/piping to prevent corrosion. Once the respondents provide information that the tanks are again protected from corrosion with passing cathodic protection testing, the red tags will be removed.
