Case summary

On August 14, Region 3 issued a Notice of Warning to Thermo Fisher Scientific of Asheville, NC for sale and distribution of misbranded pesticide devices. These pesticidal water filters had been imported into the United States through the Port of Baltimore, MD and were misbranded due to missing label information. ThermoFisher was allowed to bring the misbranded product into the country and relabel it to bring it in compliance with FIFRA. FIFRA regulates pesticidal products, which includes any substance or mechanical device intended to prevent, destroy, repel, kill, or mitigate a pest, which includes filters and UV lights intended to kill or filter out bacteria. Sale and distribution of a misbranded pesticide device is a violation of FIFRA.
