Case summary

On November 26, 2019 a Notice of Warning was issued to Rust-Oleum Corporation of Lesage, West Virginia for the sale and distribution of suspected cancelled pesticides. According to Agency records, the product registration for the pesticide, Wolman F&P Finish and Preservative , has been cancelled since September of 2015. Excluding very limited exceptions, it is a violation of FIFRA to distribute or sell any pesticide that is not registered with EPA or whose registration has been cancelled. As a result, Rust-Oleum Corporation was cited for violation of FIFRA 12(a)(1)(A) - the sale and distribution of unregistered pesticides.
