EPA v. MOLD MEDICS GLOBAL, LLC

Case summary

On September 16, 2020, EPA, Region 3 issued a Stop Sale, Use or Removal Order ( SSURO ) to Mold Medics Global, LLC ( Mold Medics ) located in Wilmington, DE, alleging violations of FIFRA. This enforcement action furthers FIFRA's purpose of promoting environmentally safe and effective pesticide use and prevents the potentially harmful use of unregistered pesticides. On April 22, 2020, EPA was alerted to Mold Medics' products when a representative of Mold Medics called Region 3's Public Information Center for information about EPA's List N: Disinfectants for Use Against SARS-CoV-2 (COVID-19). Region 3 reviewed Mold Medics' website and discovered four products offered for sale with claims indicating that their intended use is pesticidal. On May 6, 2020, an Advisory Letter was sent alerting the company about possible FIFRA violations including selling/distributing unregistered pesticides. Mold Medics made changes to its website in response to Region 3's Advisory Letter, however, the Agency determined that the changes did not resolve the company's noncompliance. The SSURO orders Mold Medics to stop any further distribution, sale, use, or removal of the four listed pesticides except in compliance with FIFRA. EPA notified PA Department of Agriculture of the action.
