Case summary
On September 8, 2020, Region 3 entered into an Administrative Order for Compliance ( AOC ) with the Mandarin Oriental Hotel Group ( Mandarin ) for their Washington, D.C. hotel to correct two violations of the Safe Drinking Water Act associated with its onsite drinking water units. The first violation came from a significant deficiency identified in EPA's April 2018 sanitary survey for Mandarin, identifying standing water in meter pits and a failure to routinely inspect the meter pits after rainfall had occurred. Mandarin submitted a Corrective Action Plan ( CAP ) to fix this significant deficiency, but failed to comply with its CAP. The second violation was a failure to submit a complete operational evaluation report ( OEL Report?) after Mandarin experiences exceedences of stage 2 disinfection byproducts sampling at two different locations. The AOC directs Mandarin to comply with its CAP, revise its Standard Operating Procedure for conducting meter pit inspections, and to submit a revised OEL Report that includes a detailed flushing plan within 45 days of the effective date of the AOC. EPA has primary enforcement responsibility for public water systems located in Washington, D.C., and implements the regulations of the District of Columbia. EPA will send a compliance assurance notification to notify the District of Columbia of the enforcement action.
