Case summary
On July 21, 2020, EPA Region III settled Clean Air Act (CAA) matter with Dominion Energy, Mt. Storm Power Station located in Mt. Storm, West Virginia. After a Risk Management Program inspection by the Oil and Prevention Enforcement Section on February 26, 2020, EPA found that the Respondent had violated regulations implementing Section 112(r) of the CAA which requires chemical accident prevention planning at facilities that use certain hazardous substances. Mt. Storm Power Station, an electric utility generating facility, uses anhydrous ammonia in its Selective Catalytic Reduction process to remove NOx. Specifically, the facility failed (1) confirm that, in the pre-startup safety review that construction and equipment were in accordance with design specifications and safety, operating, maintenance, and emergency procedures were in place and were adequate, and (2) certify its last two compliance audits, conducted in 2015 and 2018. Dominion Energy, Mt Storm Power Station has agreed to pay a cash penalty of $1,800 as part of an Expedited Penalty Action and Consent Agreement.
