Case summary
On May 5, 2020, Region III issued an Administrative Compliance Order on Consent (AOC) to the City of Carbondale, PA, (the City) alleging numerous counts of noncompliance, over several years, with a NPDES Municipal Separate Storm Sewer System Permit (MS4 Permit), issued by PADEP pursuant to the Clean Water Act. The MS4 Permit regulates stormwater discharges to portions of the Chesapeake Watershed, including Fallbrook Creek, Racket Brook Creek, the Lackawanna River and their associated tributaries. In addition to stating the factual and legal basis for numerous counts of violation of the CWA, the AOC requires the City to take specific action to achieve compliance with the MS4 Permit, including submitting portions of a written MS4 Stormwater Management Program (SWMP) to EPA for review.
