Case summary

On July 30, 2020, EPA Region III filed a signed Consent Agreement and Final Order resolving alleged violations of the Clean Water Act (CWA) by Midatlantic Realty Partners, LLC (Respondent). EPA alleged that the Respondent violated the applicable construction stormwater permit at the River Front Phase II Construction Project located at 71 Potomac Avenue SE, Washington, DC 20003. The alleged violations consisted primarily of failing to properly maintain and/or install best management practices required by the Respondent's stormwater pollution prevention plan and the applicable construction stormwater NPDES permit, issued pursuant to the CWA. EPA notified the District of Columbia about this action. This settlement was subject to a forty-day public notice and comment period and EPA received no comments from the public. The Respondent is required to pay $6,680 in penalties under the Consent Agreement and Final Order. This Consent Agreement and Final Order initiates and concludes this penalty action.
