Case summary
On May 5, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement negotiated pursuant to Section 9006 of RCRA to settle violations of RCRA Subtitle I, and Maryland's federally-authorized underground storage tank (UST) program, by the Naval Support Activity Bethesda, the owner, and the Bethesda Navy Exchange, the operator, of 14 USTs located at the Naval Support Activity Bethesda in Bethesda, Maryland. As a result of this case, Region 3's enforcement team, in coordination with the Maryland Department of the Environment, was able to resolve the UST violations of failing to conduct annual line leak detector functionality testing on two of the USTs and failing to conduct piping release detection on one of the USTs. The violations were discovered through information collected during inspections at the facility on June 26 and July 19, 2019. The respondents have agreed to pay a $2,820 penalty and have returned to compliance with the violations.
