Case summary

On June 9, 2020, EPA Region III filed a signed Consent Agreement and Final Order resolving alleged violations of the CWA by Forrester Construction Co. ( Respondent ). EPA alleged that the Respondent violated the applicable construction stormwater permit at the site known as Millenium Project Arlington National Cemetery ( Site ), located in Arlington, Virginia. The alleged violations consisted primarily of failing to properly maintain and/or install best management practices required by the facility's stormwater pollution prevention plan and the CWA permit. Virginia DEQ representatives accompanied EPA in the inspection that led to this action. EPA notified Virginia DEQ of its actions. The Respondent will pay $20,000 in penalties under the Consent Agreement and Final Order. This Consent Agreement and Final Order initiates and concludes this penalty action.
