Case summary

On December 17, 2019, a Consent Agreement and Final Order (CAFO) entered into by Region III ( EPA ) and Jay Shree Ganesh LLC (Respondent) was filed with the Regional Hearing Clerk settling alleged violations of RCRA. The alleged violations, discovered as a result of an April 12, 2018 EPA inspection at Respondent's Fuel Up Danville facility located at 600 East Market Street in Danville, Pennsylvania, involved the failure to conduct annual line leak detector testing and the failure to investigate an indication of a release of a regulated substance in connection with petroleum underground storage tank (UST) systems at the facility. Fundamental goals of RCRA and implementing UST regulations are to prevent releases and limit harm from USTs that release regulated substances. Respondent's failure to test its line leak detector increased the risk that a leak would go undetected. Further, though no release was documented, Respondent's failure to promptly investigate indications that a release of a regulated substance may be occurring for an extended period of time increased the risk the release would cause harm to human health or the environment. According to the CAFO, Respondent is assessed a penalty in the amount of twenty-seven thousand one hundred and thirty-seven dollars ($27,137) for its role as operator in the alleged violations.
