Case summary
On January 7, 2020, the Regional Judicial Officer entered a Final Order ratifying a Consent Agreement between EPA and Gelest, Inc. ( Respondent ) in settlement of RCRA Subtitle C violations at the Respondent's specialty chemicals facility located in Morrisville, Pennsylvania ( Facility ). Gelest's activities are regulated under RCRA Subtitle C because the Facility generates hazardous waste in the form of waste solvents and universal waste lamps. The Consent agreement resolves the following alleged violations: (1) operating Facility without a permit or interim status; (2) failure to keep satellite accumulation containers near the point of generation or under the control of the operator; (3) failure to keep containers of hazardous waste closed; (4) failure to make hazardous waste determinations; and (5) failure to post No Smoking signs where ignitable wastes were stored at the Facility. Under the terms of the settlement, Respondent will pay a $13,950 civil penalty. The Consent Agreement commences and resolves EPA's claims in this matter. EPA informed PADEP of this action and received no objections.
