Case summary
On April 23, 2020, the Regional Judicial Officer signed a Final Order and ratified the CAFO between EPA Region III and pesticide applicator C&S Farms, Inc., (Respondent) of Laurel, Delaware (Farm). The CAFO resolves alleged violations of FIFRA and its Worker Protection Standards (WPS), in connection with Respondent's failure to timely train agricultural workers prior to their entry onto Farm areas that had been treated with covered pesticides within the prior 30 days; failure to display a required pesticide safety poster containing important safety information; failure to display specific information about registered pesticides applied on the Farm that agricultural workers were required to receive; and failure to provide decontamination supplies while workers were performing activities in areas of the Farm that had been treated with pesticides within the prior 30 days. The settlement requires Respondent to pay a $25,000.00 civil penalty, over 6-months, for the alleged violations. EPA's WPS aims to reduce pesticide poisonings and injuries among agricultural workers and pesticide handlers. Representatives from the Delaware Department of Agriculture were present during the inspection on the Farm and were notified of this action.
