Case summary

On October 30, 2019, the Director of the Land, Chemicals and Redevelopment Division entered into three Administrative Orders on Consent ( AOCs ) pursuant to Section 7003 of RCRA with PA Opportunity Park QOF1 LLC, PA Opportunity Park QOF 4 LLC, PA Opportunity Park QOF5 LLC ( Respondents). These AOCs provide an enforcement framework which will expedite and facilitate the phased cleanup of the Budd Site located at Fox Street, Stockley Street and W. Hunting Park Avenue in the Nicetown section of Philadelphia, Pennsylvania ( Site ). Historic manufacturing operations at the Site have resulted in PCB contamination of the building structures on the Site. Respondents will submit work plans for approval and address the contamination at the Site in a phased approach with the ultimate goal of remediating the entire Site. This cleanup will allow the redevelopment of this long-vacant Site, which is located in an Opportunity Zone as well as an Environmental Justice area, and it has the support of local City leaders. EPA Region III consulted with PADEP prior to offering the Respondent these AOCs.
