Case summary
On November 19, 2019, a Consent Agreement and Final Order entered into by the U.S. Environmental Protection Agency, Region III ( EPA ) and Nelly Travel Plaza LLC ( Respondent ) was filed with the Regional Hearing Clerk settling alleged violations of the Resource Conservation and Recovery Act ( RCRA ). Respondent's failure to consistently operate its release detection equipment for extended periods of time increased the risk a leak would go undetected. According to the CAFO, Respondent is assessed a penalty in the amount of ten thousand dollars ($10,000) for its role as operator in the alleged violations.
