Case summary
On November 5, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement negotiated pursuant to Section 9006 of RCRA to settle violations of RCRA Subtitle I, and Pennsylvania's federally-authorized underground storage tank (UST) program, by Pramuk Raj, LLC. Respondent is the owner and operator of three 6,000 gallon USTs located at Ashland Food Mart in Ashland, Pennsylvania. As a result of this case, Region 3's enforcement team, in coordination with the Pennsylvania Department of the Environmental Protection, was able to resolve the UST violation of failing to conduct annual functionality testing of the line leak detectors installed on the pressurized piping. The violation was discovered through information collected during an inspection at the facility on November 9, 2017. Pramuk Raj, LLC is responsible for a $1,410 penalty and has returned to compliance with the violation.
