Case summary

On October 30, 2019 the Regional Judicial Officer signed a Final Order ratifying a Consent Agreement between EPA and Potomac Supply, LLC. (Potomac Supply), a wood treater located in Kinsale, Virginia. The Consent Agreement resolves alleged violations of RCRA C identified during a May 2017 EPA inspection of the Potomac Supply facility. The hazardous waste management regulations promulgated pursuant to RCRA Subtitle C provide for the management and transport of hazardous waste from the time and place of generation to its ultimate disposition at a RCRA treatment, storage or disposal facility. EPA routinely inspects hazardous waste generators for compliance with RCRA regulations in accordance with joint enforcement goals agreed upon by EPA and states authorized to implement RCRA C. The alleged violations of RCRA C resolved by the CAFO center around Potomac Supply's use of a drip pad area known as the Process Area at the Facility which does not meet current RCRA C Subpart W standards, as well as failure to observe general RCRA C facility standards. Potomac Supply will pay a $38,252 penalty and complete the tasks sets forth in a Compliance Order requiring a professional engineer assessment of the Process Area and the development of standard operating procedures to ensure compliance with RCRA Subpart W requirements.
