Case summary
EPA-Region III issued a Notice of Intent to Prohibit Deliveries ( NIPD ) to Nathaniel W. Garnett, d/b/a East End Spirit Chevron ( Respondents ), for violations of Subtitle I of RCRA and the Commonwealth of Virginia Underground Storage Tank ( UST ) management program regulations at the East End Spirit Chevron facility, located in Farmville, Virginia ( the Facility ). Within thirty days, the Respondent must certify that the violations identified have been addressed and provide supporting documentation to avoid having ?red tags? placed on the USTs at the Facility, rendering them ineligible to receive deliveries of regulated substances. The Respondent can request a meeting with EPA to discuss the planned prohibition of deliveries. Among the environmental concerns are potential corrosion of the USTs and leakage of the petroleum-based substances which they contain. VADEQ was notified prior to issuance of the NIPD and supports the action
