Case summary

Region 3 - Non-confidential, Enforcement On April 5, 2019, EPA finalized an Expedited Settlement Agreement (?ESA?) with Snyder Performance Engineering (SPE) resolving violations of the Section 203 of the Clean Air Act (Title II). SPE is a diesel truck service and performance upgrade sales and installation facility. Based on an inspection and an information request response letter, EPA Region 3 identified 21 violations related to the selling, offering or installation of performance tuning products, replacement pipes and exhaust gas recirculation (EGR) delete kits (collectively known as ?defeat devices?). These defeat devices alter the engine?s fueling system or enable the bypass of a vehicle?s emission control devices. As part of this ESA, Snyder agreed to cease sales and installation of any device that defeats, bypasses, or renders inoperative an emission control component of an EPA regulated engine. The settlement included payment of a penalty of $29,197.
