Case summary

On June 12, LCRD and ECAD staff inspected a shipment of pesticides being imported into the USA by Thor Specialties, Inc. of Shelton, CT. The shipment in question was listed in the US Customs and Boarder Protection's (CBP) Automated Commercial Environment (ACE) database as containing four EPA-registered pesticides (Entry Number BMB-00223006 / ACTICIDE NC, ACTICIDE PDP 20, ACTICIDE PLP 20, ACTICIDE BWS 10) intended for use as industrial microbiocides. During the inspection it was determined that only two of the four pesticides were present in the shipment. One of the products, ACTICIDE NC, was found to have non-compliant labeling and packaging, which is a violation of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). As a result, a Notice of Refusal of Admission was issued to CBP by EPA Region 3 for ACTICDE NC (FIFRA non-compliant), and ACTICIDE BWS 10 and ACTICIDE PDP 20 (not present in the shipment). The importer of record exported the non? compliant product ACTICIDE NC to Germany and provided documentation of export to EPA.
