Case summary
On April 11, 2019, Region III issued a Notice of Warning (NOW) to E.I. DuPont de Nemours and Company ( DuPont ) of Indianapolis, IN in connection with sales and distributions of a misbranded pesticide DuPont Lannate LV Insecticide , from their EPA-registered Valdosta, Georgia pesticide production establishment. The pesticide was misbranded because the label did not include the restricted use pesticide (RUP) statement. Not having the RUP statement on the label attached to the outside container increased the chances that this product may have be sold or distributed to uncertified applicators The NOW requires DuPont to respond within 10 days explaining how they plan to come into compliance with FIFRA.
