On December 6, 2018 Region 3 issued a Notice of Warning (NOW) to NewChem, Inc. in connection with sales and distribution of a misbranded pesticide. The misbranded pesticide is produced by NewChem, Inc. for Cylamune Specialty Products. The label in question does not list the correct EPA Establishment No. where the product is produced and does not correctly identify for whom the product is produced for, Cylamune Specialty Products. The NOW also cites a Section 7 violation since NewChem, Inc. submitted an incorrect Pesticide Production Report for reporting year 2017. The NOW requires NewChem, Inc. to come into compliance with FIFRA by using a fully compliant label and submitting a corrected Section 7 report.
