Case summary
On October 30, 2018, a Notice of Warning (NOW) was sent to Berkley Medical Supplies, Inc. of Smithfield, PA for violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Under FIFRA, pesticide products must bear a label containing the information specific by the Act, including appropriate precautionary statements and the directions for use. Periodically, pesticide labels will be updated by the Registrants, and new labels should bear this updated label language. An inspection conducted by the Pennsylvania Department of Agriculture using Federal Credentials revealed that Berkley Medical Supplies, Inc. was found to be selling one pesticide product bearing an out of date label. This is considered sale or distribution of a misbranded pesticide, and is a violation of FIFRA.
