Case summary

On October 31, 2018, an authorized representative of the EPA conducted an inspection of the Arctic Glacier, Inc. facility located at 410 Bethel Avenue in Twin Oaks, PA to determine compliance with the Risk Management Plan (RMP) regulations promulgated at 40 C.F.R. Part 68 under Section 112(r) of the Clean Air Act. EPA found that the Respondent had violated regulations implementing Section 112(r) of the Act, specifically, the owner or operator failed to: (1) correctly determine the worst-case release quantity [68.25(b)], (2) document that equipment complies with recognized and generally accepted good engineering practices [68.65(d)(2)], (3) ensure the frequency of inspection and tests of process equipment is consistent with applicable manufacturers' recommendations and good engineering practices (68.73(d)(3)], and (4) correct deficiencies in equipment that were outside acceptable limits defined by the process ( 68.73(e)].
