Case summary

On July 22, 2019, EPA Region III issued an Administrative Settlement Agreement and Order on Consent (Order) to Lancaster Propane Gas, Inc, the owner and operator of a liquefied propane and butane storage and distribution facility located at 55 Maibach Lane, in Mount Joy, Pennsylvania. At an inspection of the facility, EPA determined that Lancaster Propane Gas, Inc. violated CAA Section 112(r)(7), because of its failure to compile process safety information or ensure equipment achieved safety consistent with industry codes and standards, conduct a proper process hazard analysis, comply with mechanical integrity requirements, manage change, and conduct compliance audits, among other things. Under the Order, the company will hire a third party to conduct improvements at the facility to ensure compliance with applicable regulations and industry codes in order to improve public health and safety by decreasing the risk of releases of hazardous chemicals. Pennsylvania has been notified of the enforcement action but has not received delegation of Section 112(r)(7) of the CAA.
