On March 18, 2020, the Regional Judicial Officer entered a Final Order ratifying a Consent Agreement between EPA and each Respondent, Top Gas and Mini Mart, LLC, a Pennsylvania limited liability company, and Ezra Reuven, individually (collectively Respondents ) in connection with the underground storage tanks at Respondents facilities located at 4548 Baltimore Avenue, Philadelphia, Pennsylvania (the Facility ). Each Consent Agreement and Final Order resolves violations of RCRA Subtitle I, and the Commonwealth of Pennsylvania's federally authorized underground storage tank program by each Respondent as alleged in the Administrative Complaint, Compliance Order and Notice of Opportunity for a Hearing filed on September 17, 2019. Under the terms of the settlement, Respondent Ezra Reuven will pay a civil penalty in the amount of $5,000.00, and Respondent Top Gas and Mini Mart, LLC will pay a civil penalty in the amount of $1,000.00.
