Case summary

On August 21, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement negotiated pursuant to Section 9006 of RCRA to settle violations of RCRA Subtitle I, and Delaware's federally-authorized underground storage tank (UST) program, by A-Del Construction Company, Inc. Respondent is the owner and operator of three USTs located at the A-Del Construction Company facility in Oxon Newark, Delaware Department of Natural Resources and Environmental Control, was able to resolve the UST violation of failure to properly conduct tank release detection on one of the USTs at the facility. The violation was discovered through information collected during an inspection at the facility on June 5, 2018, and from information provided after the inspection. A-Del Construction Company, Inc. is responsible for a $940 penalty and has returned to compliance with the violation.
