Case summary
On July 25, 2019, EPA Region III filed signed CAFO and AOC resolving alleged violations of the CWA by Librandi's Plating, located in Middletown, Pennsylvania. EPA alleged that discharges from the Librandi's Plating facility into the collection system of a publicly-owned treatment works (POTW) violated the applicable limits imposed by the pretreatment effluent guidelines. The POTW discharges into a tributary of the Susquehanna River. The principal pollutants of concern were nickel, zinc, chromium and cyanide. EPA also alleged that Librandi's Plating failed to notify EPA after becoming aware of the exceedances, and failed to resample. EPA implements the pretreatment program in Pennsylvania. In the AOC, as part of the settlement, Respondent agreed to establish procedures to investigate and respond to any exceedances. The Respondent will pay $30,000 in penalties under the CAFO.
