On June 5, 2019, EPA Region III filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against Atomized Materials Company, Inc. (?AMC?). The Facility is located at 205 Parks Road, McDonald, Pennsylvania. AMC is a specialty coatings manufacturer. The Consent Agreement settled allegations including operating a hazardous waste treatment, storage, or disposal facility without a permit, failure to make a hazardous waste determination, failure to retain copies of hazardous waste manifests, manage satellite hazardous waste accumulation, failure to conduct weekly inspections of hazardous waste storage areas, failure to keep containers of hazardous waste closed except when adding or removing waste, and failure to failure to provide annual hazardous waste training, amount other allegations. EPA informed PaDEP of the action by letter on May 7, 2018 and received no objection. AMC asserted an Ability to Pay defense and per the terms of the Consent Agreement, will pay a civil penalty in the amount of $5,000.00.
