Case summary

On May 15, 2019, EPA-Region III entered into a Consent Agreement and Final Order (CAFO) with Respondent Budget Rentals LLC, a York, PA rental property owner/landlord with over 200 rental units, for alleged violations of the TSCA Lead-Based Paint Disclosure Rule. The alleged violations involved failure to provide lessees with required lead-based paint information. The Respondent agreed to pay a $30,000 penalty. EPA considers the alleged violations to be egregious due to the presence of children under age 6, who are susceptible to permanent neurological damage from lead poisoning. The property was built around 1900, making it very likely to contain paint with high lead content. The Lead Disclosure Rule was promulgated in 1996 to address the national prevalence of lead poisoned children due to exposure to lead-based paint. Lead-based paint remains the largest contributor to lead poisoning of children in the US. The Lead Disclosure Rule targets properties built before 1978, the year lead-based paint for residences was banned from sale in the US. Pennsylvania state officials have been notified of the planned action.
