On September 26, 2019, the Regional Judicial Officer for EPA-Region III issued a Final Order concluding a proceeding initiated by EPA under the federal Clean Air Act (CAA) against Bardon, Inc. dba Super-Concrete Corporation (Bardon) for multiple violations over a five year period of construction and operating permits issued by the District of Columbia under the CAA for Bardon?s ready mix concrete plant in the Fort Totten area of the District. Bardon violated emission standard, control device operating parameter, monitoring and recordkeeping requirements of the permits. The proceeding was initiated by a proposed consent agreement and final order, and associated penalty calculation, transmitted by EPA to Bardon as part of a pre-filing settlement opportunity. Under the terms of the settlement, a civil penalty of $259,272 will be paid by Bardon. The District of Columbia had asked EPA to assist it in the enforcement of compliance with its permits.
