Case summary

On March 28, 2019, the Regional Judicial Officer issued a Final Order ratifying a Consent Agreement between EPA, Lehigh Cement Company LLC (formerly Essroc Cement Company), and Argos USA LLC (collectively, Respondents) to simultaneously commence and resolve alleged CAA violations concerning the portland cement manufacturing facility, located at 1826 South Queen Street, Berkeley County, Martinsburg, West Virginia (Facility). EPA determined that Respondents violated certain conditions of the Facility's CAA Title V air quality operating permit related to opacity, emissions limitations, monitoring, testing, reporting and recordkeeping requirements, between 2013 and 2016, during the time each Respondent was the Facility's owner or operator . Respondents have agreed to pay a cash penalty of $1,505,309. The State is aware of and has been kept informed about this settlement.
