EPA v. KINGSBURY, INC.
Final Order With Penalty
Case summary
On February 26, 2019, EPA Region III filed an EPCRA 313 administrative Consent Agreement and Final Order which simultaneously commenced and resolved two EPCRA 313 violations alleged against Kingsbury, Inc. ( Kingsbury ), of 10385 Drummond Road, Philadelphia, PA 19154. Kingsbury operates a metal bearings manufacturing facility. Kingsbury failed to report the use or processing of Copper in 2015 and 2016 to EPA, PADEP, and the local fire chief. Complying with EPCRA helps increase the public's knowledge and access to information on chemicals at individual facilities, their uses, and releases into the environment as well as aid first responders in the event of a release or fire at the facility. States and communities, working with facilities, can use the information to improve chemical safety and protect public health and the environment. EPA consulted with the Pennsylvania Department of Environmental Protection, which expressed no objection. Pursuant to the consent agreement, Kingsbury will pay a civil penalty of $36,515.00.
