Case summary
On December 19, 2018, Region III filed a Consent Agreement and Final Order (CAFO) for violations of Maryland's Hazardous Waste Management Regulations, which Maryland administers in lieu of the federal hazardous waste management program established by RCRA Subtitle C. John Schmitz and Sons, Inc. is a commercial printer in Sparks, Maryland, and as a generator of hazardous waste, it is required to comply with the federally authorized Maryland Hazardous Waste Management Regulations, which are designed to protect human health and the environment by providing for the safe management of hazardous waste. As the result of a Compliance Evaluation Inspection and subsequent communications, EPA discovered that E. John Schmitz and Sons, Inc. had been operating a hazardous waste treatment, storage and/or disposal facility without a permit or interim status, and had failed to: describe arrangements with local authorities and list emergency equipment in its contingency plan; maintain hazardous waste training records; conduct weekly inspections of hazardous waste storage areas; and make hazardous waste determinations. Under the CAFO, E. John Schmitz and Sons, Inc. has agreed to fully comply with hazardous waste management requirements and pay a civil penalty of $24,110.00.
