Case summary
On December 6, 2018, Region III filed a Consent Agreement and Final Order resolving a violation of the Toxic Substances Control Act by Voith Hydro, Inc. at its facility located at 760 East Berlin Road, York, Pennsylvania, 17405. Voith Hydro, Inc. failed to properly identify and manifest PCB waste for shipment to a treatment, storage, and disposal facility. PCBs have been demonstrated to cause a variety of adverse health effects. PCBs have been shown to cause cancer in animals as well as a number of serious non-cancer health effects in animals, including: effects on the immune system, reproductive system, nervous system, endocrine system and other health effects. Studies in humans support evidence for potential carcinogenic and non-carcinogenic effects of PCBs. Therefore, complying with TSCA ensures tracking and proper disposal of PCBs which supports public health and the environment. EPA contacted the Pennsylvania Department of the Environment regarding this matter, which expressed no objection. Under the terms of the settlement, Voith Hydro, Inc. will pay a civil penalty in the amount of $20,470.00 and has certified that the Facility is in compliance with TSCA and the regulations promulgated there under.
